Matrimony in the Philippines: Legal Capacity, How to get it?

Have you ever heard the word ‘legal capacity’? Maybe not! Or it is your first time hearing it when you are looking for information on how to get married in the Philippines with your foreign fiancé.

Thanks to the Internet, you can easily search what it is and how to get it, especially on the website of the embassy of your fiance’s nationality.They might write all the details there; But you are still wondering what the first step to take in order to obtain legal capacity!

Of course, before anything else, you need to inquire with the Civil Registrar Office first about the list of documents needed for matrimony, and one of these documents is legal capacity.

So in this blog we will focus on how an Italian national can obtain this document to marry a Filipina in the Philippines.

As I visit the website of L’Ambasciata Italiana Manila to see the information about Legal capacity,they already updated their website and they inserted lots of information about it. You only need to do is visit and explore their website.

But anyway if you’re not really familiar with how a website works you may get lost inside, so here I am to guide you how to get the specific information and step by step to get this document.

  1. First thing you have to do is visit Ambasciata d’Italia in Manila, then choose the English language so you can understand everything written on this website. 
  2. Second search “legal capacity” then click “Read more.”  See the video below for reference.
  3. Third, when you get inside to this portion of obtaining legal capacity, you are instructed to set an appointment at the Consular office of the Embassy of Italy,5th Floor, Tower B, One Campus Place Campus Avenue, McKinley Hill Dr, Taguig, 1630 Metro Manila, Philippines. (Please click here to redirect for setting an appointment)

Consular Section is open with these schedules: 

Mondays, Tuesdays, and Fridays, 9:00 am to 12:00 pm,  Wednesdays, from 9:00 am to 4:00 pm, with one hour lunch break, and Thursdays they are closed.

I suggest that you should book an appointment as early as possible,before your Italian partner arrives in the Philippines, so you wouldn’t have to wait for a long time just for this document.

4. Fourth:Before you go to your appointment (CONFIRMED APPOINTMENT), both of  you should have these documents:

  • Passport (both parties)
  • Certificato di stato libero for Italian national (like cenomar)
  • Certificato di nascita (Birth certificate)
  • Birth certificate issued by Philippines Statistic Authority for Filipino nationals.
  • CENOMAR for Filipino national

The legal capacity will be released on the same day, I suggest that if you still have enough time for this day, you may proceed to the next step which is APPLYING FOR MARRIAGE LICENSE from the city you wanted to celebrate your matrimony. (Please read here How to apply FOR MARRIAGE LICENSE.)
